Terms of Service, Photo Copyright & Usage Rights

Terms of Service

The client represents to us that it has the rights to photograph the location, building, or real estate that is the subject of this shoot & that we are given permission to be on-site for purposes of providing our services.

All photo compositions are at the discretion of the photographer unless specific requests have been mentioned during booking. The photographer will not move furniture or other items during the shoot & will not stage or clean the home. Any items that are not wanted in the photos must be stored out of sight.

We perform post-processing on photos & will make reasonable efforts to honor client requests related to post-processing preferences, however, extensive editing or item removal may incur an additional charge, which will be discussed with the client prior to proceeding. We are unable to honor requests that would misrepresent the real estate or location in any manner that violates MLS rules or which could constitute false advertising.

Payment for photography services is due upon delivery of the content for MLS listings. We will deliver photos & virtual tours electronically within 24 hrs. of the date/time of the shoot; videos, floor plans & virtual staging may require up to 48 hrs. for delivery. For all other clients, payment terms will be agreed upon & detailed on the estimate provided before work commences.

Photo/Media Copyright & Usage Rights

For non-MLS: we grant our clients a non-exclusive, non-transferable, perpetual, commercial use license from the date of payment of the invoice, provided all other terms of the license have been complied with. Included are all marketing purposes (digital & print) & all portfolio uses (digital & print). An extension of this license may be granted to other parties at our sole discretion for an additional fee. At no time may the content be sold or transferred to any other party.

For MLS listings, we grant our clients a non-exclusive, non-transferable, limited license of the provided content for use in marketing the property for a period of 12 months from delivery & for portfolio use by the original listing agent in perpetuity, provided all other terms of the license have been complied with. If the property does not sell during this period or an agent from another broker lists the property, no other agent or broker may use the content & this license will convert to portfolio use only, as noted above. An extension of this license may be granted to agents or brokers in the same physical office location upon request. At no time may the content be sold to any other party.

All content created is the copyrighted, exclusive, intellectual property of Chuck Perry Photography. We retain our right to use any or all of the content for our portfolio, advertising or for any commercial purpose. We retain our full rights to use any content in any legal manner.
